About this policy

Residia Property Group Pty Ltd (ABN 11 696 675 653) ("Residia", "we", "us") provides buyer's agency, vendor advocacy, asset management (property management) and Property Care services in South Australia. We respect your privacy. This policy explains what personal information we collect, why we collect it, how we use, share and protect it, and how you can access or correct it.

We handle personal information in line with the Privacy Act 1988 (Cth), including the Australian Privacy Principles, and the laws that govern real estate in South Australia, including the Land Agents Act 1994 (SA), the Land and Business (Sale and Conveyancing) Act 1994 (SA) and the Residential Tenancies Act 1995 (SA). We also have obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth).

The information we collect

The information we collect depends on how you deal with us. It may include:

  • Contact details, such as your name, phone number, email address and postal or residential address.
  • Property information, such as properties you own or want to buy, sell or rent, your budget, preferences, timing and finance status.
  • Identity and verification information, such as identification documents and other information we are required to collect to verify your identity, including under anti-money laundering and counter-terrorism financing laws.
  • Tenancy information, such as rental applications, employment and income details, rental history, references and, where permitted by law, tenancy database checks.
  • Financial information, such as bank account details for rent and disbursements, invoices and payment records.
  • Records of our dealings, such as enquiries, correspondence, notes of calls and meetings, inspection reports, maintenance records and photographs of properties.
  • Job applications, such as your resume, qualifications, references and the information you send us through our careers page.
  • Website information, such as the details you submit through our forms, and basic technical information (such as IP address and browser type) recorded by our website host for security.

We only collect sensitive information (such as health information) where it is reasonably necessary and you consent, or where the law requires or allows it.

How we collect it

We collect most information directly from you, for example when you fill in a form, call or email us, meet with us, apply for a rental or apply for a role. We may also collect information from other people where you have agreed or the law allows, such as selling agents, property managers, referees, your representatives (for example your solicitor, conveyancer or finance broker), tenancy databases, and public sources such as property records and listing portals including realestate.com.au.

Why we collect and use it

We collect, hold and use personal information to:

  • provide our services, including searching for, inspecting, assessing, negotiating and settling property purchases, advocating for vendors, leasing and managing properties, and arranging Property Care and maintenance;
  • assess rental applications and manage tenancies;
  • collect and disburse rent and other money;
  • arrange work with our maintenance partner and trades;
  • verify identity and meet our legal and regulatory obligations, including record keeping, trust accounting, tenancy and anti-money laundering requirements;
  • respond to your enquiries and keep you informed;
  • consider job applications; and
  • tell you about our services, where you have not opted out.

Who we share it with

We only share personal information where it is needed for the purpose it was collected, where you have agreed, or where the law requires or allows it. This may include:

  • our team and the contractors who help us deliver our services, including our building maintenance partner, Managed Property Solutions, and local trades (for example, access details for a scheduled visit);
  • other parties to a transaction or tenancy, such as selling agents, vendors, landlords, tenants, conveyancers, solicitors, finance brokers and building and pest inspectors;
  • our service providers, such as our client relationship management and property management software providers, email, website hosting, online form and accounting providers;
  • listing portals such as realestate.com.au when we advertise a property for lease or sale;
  • tenancy databases, where permitted and after letting you know; and
  • government bodies, regulators, tribunals and courts where required by law, such as Consumer and Business Services, AUSTRAC and the South Australian Civil and Administrative Tribunal.

We do not sell your personal information.

Overseas disclosure

Some of our service providers store data outside Australia. For example, the service that delivers our website form submissions is based in the United States, and some cloud software we use may store data in other countries. Where we use overseas providers, we take reasonable steps to make sure they handle your information in a way that is consistent with the Australian Privacy Principles.

Marketing

We may send you information about our services. Every marketing email includes a way to unsubscribe, and you can ask us to stop at any time. We comply with the Spam Act 2003 (Cth).

Our website

This website does not use advertising or analytics cookies. When you submit a form, the details you enter are sent to us by email. Buyer's Agency enquiries are also recorded in our client relationship management system so we can respond and look after your brief. Our website links to other sites, such as Instagram, Facebook, LinkedIn, realestate.com.au and our partners' websites, which have their own privacy policies.

How we protect and keep it

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, change or disclosure. These include access controls, secure software providers and training for our team. We keep information for as long as we need it for the purpose it was collected and for any period the law requires, for example records relating to transactions, trust accounts, tenancies and identity verification. When we no longer need it, we securely destroy it or de-identify it.

Data breaches

If a data breach is likely to result in serious harm to anyone, we will notify the people affected and the Office of the Australian Information Commissioner, as required by the Notifiable Data Breaches scheme.

Accessing and correcting your information

You can ask to see the personal information we hold about you, or ask us to correct it. Please contact us using the details below. We will respond within a reasonable time, usually within 30 days. If we can't give you access or make a correction, for example where the law allows us to refuse, we will tell you why in writing.

Dealing with us anonymously

You can make a general enquiry without giving us your name. To provide most of our services, though, we need to know who you are.

Complaints

If you have a concern about how we have handled your personal information, please contact our Privacy Officer. We will acknowledge your complaint and aim to respond within 30 days. If you are not satisfied with our response, you can contact the Office of the Australian Information Commissioner at oaic.gov.au or on 1300 363 992. Complaints about the conduct of a real estate business in South Australia can also be made to Consumer and Business Services at cbs.sa.gov.au.
